Late Tax Filing Penalties in Nigeria: What It Actually Costs You

Filing your taxes late in Nigeria is not just about shame. There are real financial penalties, and they stack up faster than most people realize. Whether you are an individual or a business, here is what happens when you miss the deadline.

    Individual Late Filing Penalties

    Personal Income Tax (PIT)

If you file your annual returns after the deadline (typically March 31 for the previous year), you face:

    • •First penalty: NGN 5,000 for individuals, NGN 25,000 for businesses, in the first month
    • •Monthly penalty: NGN 2,500 for individuals, NGN 25,000 for businesses, for each subsequent month of default
    • •Interest: 10-21% per annum on unpaid tax, calculated daily

    Example:

If you owed NGN 200,000 in PAYE and filed 6 months late:

    • •Filing penalty: NGN 5,000 + (5 × NGN 2,500) = NGN 17,500
    • •Interest on NGN 200,000 at 15% p.a. for 6 months: NGN 15,000
    • •Total damage: NGN 32,500 extra

That is money you did not need to spend.

    Company Late Filing Penalties

    Company Income Tax (CIT)

    Companies face steeper consequences:

    • •Late filing penalty: NGN 25,000 for the first month, NGN 5,000 for each additional month
    • •Late payment penalty: 10% of the tax due, plus interest at CBN rediscount rate + spread
    • •Director liability: In extreme cases, directors can be held personally liable

    VAT Late Filing

    • •Penalty: NGN 5,000 for the first month, NGN 2,500 for each subsequent month
    • •Interest: 5% per month on outstanding VAT

    Withholding Tax (WHT)

If you collect WHT on behalf of the government but do not remit:

    • •Penalty: 10% of the unremitted amount plus interest
    • •Criminal prosecution: Possible for deliberate evasion

    State-Level Penalties

Each state has its own penalty structure for state taxes. Lagos (LIRS) is particularly aggressive:

    • •Late filing: NGN 100,000 for businesses
    • •Late payment: Interest at CBN rate + 10%
    • •Additional assessment: LIRS can raise additional assessments going back 6 years

Other states like Rivers, FCT, and Ogun also have significant penalty structures.

    What About FIRS vs NRS?

The Nigeria Revenue Service (NRS, formerly FIRS) took over federal tax administration in January 2026. Under NTA 2026, the penalty regime was updated:

    • •Penalties are now standardized across all federal taxes
    • •The NRS has broader powers for enforcement
    • •Digital tracking means they know who has not filed

How To Minimize Late Filing Damage

If you have already missed the deadline, here is what to do:

    1. File Immediately

Every day you wait, interest accumulates. File now, even if you cannot pay the full amount yet.

    2. Pay What You Can

Partial payment reduces the interest calculation base. If you owe NGN 500,000 but can only pay NGN 200,000 now, pay it. Interest then accrues on NGN 300,000 instead of NGN 500,000.

    3. Request a Payment Plan

The NRS and state revenue services allow installment payment plans. Request one formally in writing.

    4. Check for Errors

Sometimes the penalty is calculated on an incorrect assessment. Review the numbers. If the tax authority over-assessed, you can object.

    5. Keep Records

Document everything. If you ever face enforcement action, having filed voluntarily (even late) is much better than being caught.

The Real Cost of Not Filing

Beyond penalties, not filing has other consequences:

    • •No Tax Clearance Certificate (TCC): You cannot get government contracts, loans, or visas
    • •Audit risk: Non-filers are prioritized for tax audits
    • •Criminal charges: Willful failure to file can result in prosecution
    • •Credit impact: Increasingly, tax compliance affects business creditworthiness
